Independent Contractor Agreements

According to the IRS, people such as doctors, dentists, veterinarians, lawyers, accountants, contractors, subcontractors, public stenographers, or auctioneers who are in an independent trade, business, or profession in which they offer their services to the general public are generally independent contractors.  The general rule is that an individual is an independent contractor if the payer has the right to control or direct only the result of the work and not what will be done and how it will be done. The earnings of a person who is working as an independent contractor are subject to Self-Employment Tax.

Independent Contractor Agreements

Single-Use Agreements

Nye Law Group, Ltd. drafts “Single Use Agreements” Independent Contractor Agreements specific for the needs of individual agencies/practices that require only one independent contractor agreement within a 12 month period.

Our office can help therapists/agencies/practices to create and negotiate a unique Independent Contractor Agreement that lays out the specific obligations and rights between the contracting agency/practice and the independent contractor. We work hard to provide specific agreements which identify the rights and obligations of both the contracting agency/practice and the independent contractor. Examples of obligations include charting (including when chart updates are due), clinical consultation and supervision, co-payment and deductible collections, obligation to provide malpractice insurance, participation in the billing and collections processes, non-compete, minimum level of clinical obligations, payment to the contractor and other terms related to the agency/independent contractor relationship.

Multi-Use Agreements

Nye Law Group, Ltd. drafts “Multi-Use Agreements” Independent Contractor Agreements specific for the needs of individual agencies/practices that require more than one independent contractor agreement within a 12 month period. This option provides a discounted rate that licenses the use of the contract for an unlimited number of independent contractors over a 12 month period. The agreement allows the agency/practice to utilize a form for this specific period in situations where there are only minimal differences between agreements, contractor to contractor, that do not require any formal modification of the drafted agreement.
